We provide a platform where businesses connect their social media accounts to publish content, monitor and respond to incoming comments and direct messages, capture and qualify leads, and generate text, images, and video using artificial intelligence. Businesses can configure automated agents to draft or send responses on their behalf, and can upload documents to inform those responses.
  • Engage with us in other related ways, including any marketing or events

In what situations and with which parties do we share personal information? We share information with the service providers that help us operate the Services, and with the social media platforms you direct us to publish to. No. We do not use your content to train general-purpose artificial intelligence models, and we transmit your content to our AI providers under terms that do not permit them to use it to train their general-purpose models. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. 1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • names
  • email addresses
  • usernames
  • contact preferences
  • profile pictures
  • organization details, such as organization name, description, industry, support email, and time zone
  • content you submit for publication, including text, images, and video
  • documents you upload to your knowledge base
  • messages you send to our AI agents
  • support requests and their contents
  • authorization credentials, including access and refresh tokens, for the social media accounts you connect

Sensitive Information. We do not request or intentionally collect sensitive personal information, and we ask that you do not submit it to us. Because the Services receive comments and direct messages written by members of the public, and because you may upload documents of your choosing, information that some jurisdictions treat as sensitive may reach us incidentally. Our automated processing is not designed to identify, infer, or act on sensitive categories, we do not use such information for targeted advertising, and we do not sell or share it. If you believe sensitive personal information has been submitted to us, please contact us at privacy@agntlab.com and we will delete it.

Payment Data. We use Stripe to process payments and manage subscriptions. Payment card details are entered on a checkout page hosted by Stripe and are processed directly by Stripe. We do not receive or store your card number, and we do not store your billing address. From Stripe we receive and store a customer identifier, a subscription identifier, the plan you have selected, your subscription status, and your current billing period, which we use to provide the Services associated with your plan and to apply its limits. Your use of Stripe's checkout and billing portal is also subject to Stripe's privacy notice, which you may review at https://stripe.com/privacy.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, country, approximate region, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date and time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), and error reports.
  • Device Data. We collect device data such as information about the computer, phone, tablet, or other device you use to access the Services. This device data may include your IP address (or proxy server), browser type, operating system, and system configuration information.
  • Location Data. We collect approximate location data derived from your IP address, such as the country and region from which you access the Services. We do not collect precise geolocation data, and we do not access location services on your device.
  • Service usage data. Service usage data is information about how you use the Services that we record against your account. Examples include the number of agent runs performed, content credits consumed, storage used, and the activity recorded in your organization's history.
  • Account session data. Account session data is information about your sign-in sessions. Examples include the IP address, browser, operating system, and device used to access your account, which we show to you in your account settings so that you can review active sessions and sign out of them.

Google API

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

Information collected from other sources

In Short: We receive information about you from the social media platforms you connect, from our payment processor, and from other members of your organization.

We obtain information about you from the following outside sources:

  • Social media platforms you connect. When you connect a social media account, the platform provides us with the account name, an account identifier, the profile image, the permissions you granted, and metrics about the account such as follower counts.
  • Our payment processor. Stripe provides us with your customer and subscription status as described under Payment Data above.
  • Other members of your organization. A member of an organization may provide us with your email address in order to invite you to join that organization.

We do not purchase personal information from data brokers, and we do not obtain personal information from public databases, joint marketing partners, affiliate programs, or data providers for advertising purposes.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
  • To generate content using artificial intelligence. We may process your information to generate text, images, and video at your direction, including drafting posts for your connected social media accounts. This involves sending your prompts and related content to our artificial intelligence providers.
  • To draft and send responses on your behalf. We may process the comments and direct messages received by your connected social media accounts in order to draft suggested responses, and to send those responses where you have enabled automatic sending. You control whether responses are sent automatically or held for your approval.
  • To identify and qualify sales leads. We may process interactions with your connected social media accounts to create lead records, and to assign a stage, score, and summary to each lead so that you can prioritize follow-up.
  • To process payments and manage subscriptions. We may process your information to take payment, manage your subscription, and apply the plan limits and usage credits associated with your plan. Payment card details are collected and processed by our payment processor and are not stored by us.
  • To respond to user inquiries and offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and notifications about activity in your account, such as responses awaiting your approval.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences.   • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention, scanning uploaded files for malware, and screening generated content before it is published or sent.
  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience. We do not use your content to train general-purpose artificial intelligence models.
  • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
  • To comply with our legal obligations. We may process your information to comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We share information with the service providers that operate the Services on our behalf, and with the social media platforms you direct us to publish to. We do not sell your personal information.

Service providers. We disclose personal information to the service providers that help us operate the Services. Each of them processes that information on our instructions and under a written contract, and none of them is permitted to use it for their own purposes. They are:

  • OpenAI — text generation, drafting of suggested responses, and image generation. Receives your prompts, chat content, knowledge base content, and the text of comments and direct messages received by your connected accounts.
  • Google Cloud — video generation through Vertex AI, file storage, and secret management. Receives your prompts, uploaded files, and generated media.
  • Stripe — payment processing and subscription management. Receives your billing and transaction information.
  • SendGrid — delivery of transactional and marketing email. Receives your name and email address.
  • Keycloak — authentication, session management, and device management. Receives your credentials, profile, and session information.
  • Google Analytics — website analytics. Receives your IP address and information about your activity on our website.
  • Termly — consent management for our cookie banner. Receives your IP address and the cookie choices you make.

Connected social media platforms. When you connect a social media account and direct us to publish content, send a message, or post a reply, we transmit that content to the relevant platform on your behalf. Those platforms are Facebook, Instagram, LinkedIn, X, TikTok, and YouTube. Your use of each platform is governed by that platform's own terms and privacy policy, which we do not control. See HOW DO WE HANDLE YOUR CONNECTED SOCIAL MEDIA ACCOUNTS? below.

We may also need to share your personal information in the following situations:

  • Members of your organization. Information belonging to an organization is visible to the members of that organization, as described in WHAT CAN OTHER MEMBERS OF YOUR ORGANIZATION SEE? below.
  • Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Legal obligations and protection of rights. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, or where disclosure is necessary to protect our rights, your safety, or the safety of others.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We use cookies for essential site functions and for analytics. We do not use cookies for advertising.

We use cookies and similar tracking technologies to gather information when you interact with our Services. Some of these technologies are essential: they maintain the security of our Services and your account, keep you signed in, save your preferences, and support basic site functions.

We also use analytics cookies to understand how our website is used so that we can improve it. These are blocked until you accept them in the consent banner shown on your first visit to our marketing website, and you can change your choice at any time using the "Consent preferences" link in our website footer. We do not use cookies, web beacons, or pixels to deliver advertising, we do not permit third parties to use tracking technologies on our Services for advertising, and we have not enabled any advertising features in our analytics tools.

Most web browsers are set to accept cookies by default. If you prefer, you can usually set your browser to remove or reject cookies. If you choose to remove or reject cookies, this could affect certain features or services of our Services.

Google Analytics

We share information with Google Analytics to track and analyze the use of our website. Google Analytics collects your IP address and information about your activity on the site, and derives approximate location from your IP address. We have not enabled Google Analytics Advertising Features, Google Signals, remarketing, or demographics and interests reporting. To opt out of being tracked by Google Analytics across websites, visit https://tools.google.com/dlpage/gaoptout. 5. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

In Short: We offer products, features, and tools powered by artificial intelligence, machine learning, and similar technologies. We do not use your content to train general-purpose models.

As part of our Services, we offer products, features, and tools powered by artificial intelligence, machine learning, and similar technologies (collectively, "AI Products"). The terms in this Privacy Notice govern your use of the AI Products within our Services.

Use of AI technologies

We provide the AI Products through third-party service providers ("AI Service Providers"), namely OpenAI and Google Cloud AI. Your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products. You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

Our AI products

Our AI Products are designed for the following functions:

  • content and text generation
  • image generation
  • video generation
  • chatbot and conversational AI
  • document analysis and search
  • AI automation
  • AI bots
  • AI insights
  • AI predictive analytics

How we process your data using AI

The following categories of information are transmitted to our AI Service Providers:

  • the prompts and instructions you give to an agent
  • the content of your chat conversations with an agent
  • content from the documents you upload to your knowledge base, including embeddings generated from that content
  • the text of comments and direct messages sent to your connected social media accounts by members of the public, which is transmitted in order to draft a suggested response
  • content you submit for publication, in order to generate or refine it

Output is generated probabilistically and may be inaccurate, incomplete, or similar to output generated for other users. You are responsible for reviewing output before it is published or sent, and for configuring the autonomy level of each agent appropriately. Where automated screening of generated content is provided, it is not guaranteed to identify all unsuitable content.

Model training

We do not use your content to train general-purpose artificial intelligence models, and we transmit your content to our AI Service Providers under terms that do not permit them to use it to train their general-purpose models. We may process your content to provide and improve the Services for you, including generating embeddings, summaries, and suggested responses, and we may use aggregated, de-identified data that does not identify you or any individual. We will not use your content to train general-purpose models unless you opt in in writing.

How to opt out

The Services cannot be provided without processing your content through our AI Service Providers, so we do not offer a way to use the AI features without that processing. You do control what information is processed and what happens to the result. You can:

  • choose which social media accounts to connect, and disconnect them at any time
  • choose whether drafted responses are sent automatically or held for your approval
  • pause your agents
  • turn individual capabilities off for each agent, including monitoring, drafting, publishing, and lead qualification
  • remove documents from your knowledge base, which deletes the stored file and ends your agents' access to it

6. DO WE HOLD INFORMATION ABOUT PEOPLE WHO ARE NOT OUR USERS?

In Short: Yes. When a customer connects a social media account, we receive and store the comments and direct messages that members of the public send to that account.

Our customers use the Services to manage their own social media presence. When a customer connects an account, we receive and store information about the people who interact with that account, even though those people are not our users. This information may include:

  • the sender's name, username, and platform identifier
  • the full text of direct messages sent to the connected account
  • the text of comments, together with reactions and the associated post or permalink
  • lead records created from those interactions, which may include a name, username, email address, phone number, the source and count of interactions, and an automatically generated stage, score, sentiment, and summary

Our role. For this information, the customer who connected the account decides what is collected and why, and we process it on that customer's instructions in order to provide the Services to them. Our customers are responsible for having a lawful basis for the collection and use of this information and for providing any notice required by law to the individuals concerned.

Automated analysis. The stage, score, sentiment, and summary attached to a lead record are generated automatically by artificial intelligence in order to help a customer prioritize follow-up. They are not used to make decisions that produce legal or similarly significant effects for the individual concerned, and a customer can turn lead qualification off entirely for any agent.

If we hold information about you and you are not a user. If you have contacted one of our customers through a social media account they manage with the Services, and you wish to access, correct, or delete the information we hold about you, please contact us at privacy@agntlab.com. Because we process this information on behalf of our customer, we may need to refer your request to them, and we will tell you when we do so.

7. HOW DO WE HANDLE YOUR CONNECTED SOCIAL MEDIA ACCOUNTS?

In Short: Connecting an account allows us to publish and respond on your behalf. You can disconnect at any time, and we delete the credentials when you do.

The Services allow you to connect social media accounts that you own or manage on Facebook, Instagram, LinkedIn, X, TikTok, and YouTube. These are connected publishing and inbox channels, not a way of signing in to the Services. When you connect an account, you authorize us to act on your behalf on that account to the extent permitted by the permissions you grant and the settings you configure.

When an account is connected, we may:

  • store the authorization credentials for that account, including access and refresh tokens, which we encrypt at rest
  • publish content that you or your agents have created
  • retrieve the comments and direct messages the account receives, and post replies
  • retrieve metrics about the account, such as follower counts, in order to show them to you

Disconnecting. You may disconnect a social media account at any time from your account settings. When you disconnect an account, we delete the access credentials we hold for it, and your agents immediately lose the ability to read from or post to that account. If you would also like us to delete the content we retrieved through that account, contact us at privacy@agntlab.com.

Platform terms. Your use of each connected platform is governed by your agreement with that platform. You are responsible for complying with each platform's terms, policies, and community standards, and a platform may suspend or restrict your account for conduct occurring through the Services.

YouTube

The Services use YouTube API Services in order to upload videos and thumbnails to a YouTube channel you have connected. By connecting a YouTube channel you agree to be bound by the YouTube Terms of Service. Information we obtain through YouTube API Services is handled in accordance with the Google Privacy Policy. You can revoke our access to your Google account at any time through the Google security settings page at https://myaccount.google.com/permissions.

8. WHAT CAN OTHER MEMBERS OF YOUR ORGANIZATION SEE?

In Short: Members of an organization can see each other and the organization's content. Nothing is made public through the Services.

Users of the Services belong to one or more organizations. Within an organization, members can see the name, email address, and role of other members of that organization, and can see the agents, connected accounts, content, documents, leads, and message history that belong to that organization. Organization owners and administrators can additionally invite and remove members and change their roles.

Information belonging to an organization is not visible to users outside that organization, and is not made public through the Services. Content that you publish to a connected social media account is, of course, visible on that platform according to that platform's settings.

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

Closing your account does not by itself delete your information. Closing your account from your account settings deactivates it and ends your access to the Services. To request deletion of the personal information associated with your account, contact us at privacy@agntlab.com.

Information about people who are not users. Comments, direct messages, and lead records described in DO WE HOLD INFORMATION ABOUT PEOPLE WHO ARE NOT OUR USERS? are retained for as long as the organization that collected them maintains an account with us, or until that organization deletes the record.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We maintain technical and organizational measures designed to protect personal information. These include:

  • encryption of data in transit
  • encryption at rest of the access credentials for connected social media accounts and of the content of direct messages and comments
  • storage of application secrets in a managed secret store
  • database access restricted to authorized services over a private connection
  • scanning of uploaded files for malware before they are made available to your agents
  • authentication managed through a dedicated identity provider with session and device management
  • role-based access controls that limit access to information within your organization

Media files. Images, video, and other media that you upload or generate are stored at web addresses that are not guessable but that do not require sign-in. Anyone who has the address of a file can retrieve it.

Despite our safeguards and efforts to secure your information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

11. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services.

Separately from the accounts we hold for our own users, the Services receive comments and direct messages sent by members of the public to social media accounts that our customers have connected. We do not control who sends those messages and cannot verify a sender's age. We do not knowingly use that content to build profiles of children under 18.

If we learn that personal information from a person under 18 years of age has been collected, we will deactivate the account where applicable and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from a child under 18, please contact us at privacy@agntlab.com.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us using the contact details provided in HOW CAN YOU CONTACT US ABOUT THIS NOTICE? below. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in HOW CAN YOU CONTACT US ABOUT THIS NOTICE? below. You will then be removed from the marketing lists. Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account.
  • Contact us using the contact information provided.
  • Close your account from your account settings, which deactivates the account and ends your access.
  • Contact us at privacy@agntlab.com to request deletion of the personal information associated with your account.

Closing your account deactivates it and ends your access, but does not by itself delete the information associated with it. Upon a verified request to delete that information, we will acknowledge your request and delete the personal information we hold about you. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements. Technical derivatives generated from your content, such as embeddings created from documents you upload, and copies held in backups, may persist for a period after content is removed from the live Services.

Cookies and similar technologies: Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. 13. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

Will your information be shared with anyone else?

We disclose personal information to our service providers pursuant to a written contract between us and each service provider. The categories of third parties to whom we disclose personal information, and the purposes for which we do so, are listed in WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION? above.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

We have not sold personal information in the preceding twelve (12) months, and we have not shared personal information for targeted advertising or cross-context behavioral advertising in the preceding twelve (12) months. We will not sell your personal information, and we will not share it for targeted advertising. Your Rights

You have rights under certain US state data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law. These rights include:

  • Right to review, understand, question, and depending on where you live, correct how personal data has been profiled (as permitted by applicable law, including the privacy law in Connecticut and Minnesota)
  • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including the privacy law in California)
  • Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including the privacy law in Florida)

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at privacy@agntlab.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California "Shine The Light" Law

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes.
